La formación docente es indispensable para responder a los requerimientos de la compleja sociedad actual. De su conocimiento, iniciativa, praxis y creatividad depende el éxito o el fracaso del sujeto que aprende. Al modificar el rol del docente se transforma la actitud de los estudiantes. ¿Cómo entender la formación filosófica transdisciplinar? Este texto responde a este y otros cuestionamientos: ¿cuáles son los planteamientos pedagógicos afines a la era digital? ¿en qué medida las TIC se encuentran al servicio de una filosofía (...) educativa transdisciplinar?, ¿cómo se explica ese enfoque en la formación del docente?, ¿cuál es la función de la formación en la innovación educativa?, ¿cómo formar para la ciudadanía mundial?, ¿cuáles son las contribuciones de las nuevas ciencias para la formación educativa? El crecimiento exponencial de la ciencia y de la tecnología nos obliga a pensar en procesos formativos innovadores. En tal sentido, resulta imprescindible el estudio de estas problemáticas. (shrink)

En este ensayo intentaremos realizar una pequeña aproximación al pensamiento de Gilbert Simondon, filósofo francés cuya obra podría resumirse en sus dos tesis doctorales defendidas en 1958, una de las cuales no fue publicada de forma completa sino póstumamente. No obstante, lo dicho, tras el creciente interés en su pensamiento comenzaron a publicarse ya nacido este milenio, en particular en Argentina, sus cursos sobre percepción, imaginación, invención, información, comunicación y tecnología. A pesar de su escueta obra, Simondon es un filósofo (...) de sistema, que a partir de su teoría de la individuación intentó fundar un monismo ontogenético en el cual puedan entrar en comunicación todas las disciplinas humanas; y para ello buscó explotar todos los recursos conceptuales que brindaron las revoluciones científicas de su época. En este ensayo, sin embargo, abordaremos tan sólo el tipo de realidad o estatus ontológico que Simondon atribuía a los objetos técnicos. Para ello desarrollaremos 4 apartados y un bis. En el primero, haremos un esbozo de lo que es el método filosófico propuesto por Simondon, el cual describimos como un paradigmatismo analógico. En el segundo, desarrollaremos algunas críticas a cierto paradigmatismo particular que, según Simondon, subyace en gran parte del pensamiento occidental y que nos impide, entre otras cosas, comprender la realidad propia de los OT, a saber: el hilemorfismo. En tercer lugar, analizaremos en qué medida podemos salvar la realidad de los OT de ser reducida a mero constructo social. En cuarto lugar; analizaremos algunas analogías y disparidades entre los OT y los seres vivientes. Por último, a modo de apéndice, expondremos sucintamente un artículo de Esperanza García y Villegas Jaraleño, presentado en el último volumen de Scientia in verba, en el cual se plantea la pregunta sobre el estatus ontológico de los artefactos biotecnológicos desde una perspectiva bungeana; así como pequeñas críticas y aportes que pudiésemos hacerle desde el pensamiento simondoniano. Filosofia limbajului are legătură cu studiul modului în care limbajul nostru se implică și interacționează cu gândirea noastră. Studierea logicii și relația dintre logică și vorbirea obișnuită poate ajuta o persoană să își structureze mai bine propriile argumente și să critice argumentele celorlalți. Înțelesul este modul în care pot fi considerate în mod corespunzător cuvinte, simboluri, idei și convingeri, definiția sa depinzând de teoria abordată, precum teoria corespondenței, teoria coerenței, teoria constructivistă, teoria consensului sau teoria pragmatică. Există mai multe explicații (...) distince despre ceea ce înseamnă un „sens” lingvistic, în funcție de diverse teorii (ideologice, adevăr-condiționale, de utilizare a limbajului, constructiviste, de referință, verificaționiste, pragmatice, etc.) Investigațiile privind modul în care limbajul interacționează cu lumea sunt numite teorii de referință. Sensul unei propoziții este gândul pe care îl exprimă. Un astfel de gând este abstract, universal și obiectiv. Sensurile determină referința și sunt, de asemenea, modurile de prezentare a obiectelor la care se referă expresiile. Referințele sunt obiectele din lume despre care vorbesc cuvintele. Filosofia limbajului explorează relația dintre limbă și realitate, în special filosofia problemelor de studiu lingvistic care nu pot fi abordate de alte domenii. In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. I argue racial injustice undermines the reliability of news source reports in the information domain of racial injustice. I argue that this in turn undermines subjects’ doxastic justification in inferences they base on these news sources in the racial injustice information domain. I explain that racial injustice does this undermining through the effect of racial prejudice on news organizations’ members and the effect of society's racially unjust structure on non-dominant racial group-controlled news sources.

This article defends a relational account of personhood. I argue that the structure of personhood consists of dyadic relations between persons who can wrong or be wronged by one another, even if some of them lack moral competence. I draw on recent work on directed duties to outline the structure of moral communities of persons. The upshot is that we can construct an inclusive theory of personhood that can accommodate nonhuman persons based on shared community membership. This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

I argue that Bartolomé de las Casas and Juan Ginés de Sepúlveda differed in their conclusions regarding the status of Indigenous persons at least partly because las Casas had significant, yet incomplete, understanding of Indigenous persons, culture and societies and Sepúlveda had mere knowledge of them. To this end, I show that the epistemic state of understanding explains why Las Casas properly concluded that Indigenous persons deserve the same moral status afforded to Europeans. The picture of moral development defended by followers of Aristotle takes moral cultivation to be like playing a harp; one gets to be good by actually spending time playing a real instrument. On this view, we cultivate a virtue by doing the actions associated with that virtue. I argue that this picture is inadequate and must be supplemented by imaginative techniques. One can, and sometimes must, cultivate virtue without actually performing the associated actions. Drawing on strands in Buddhist philosophy, I (...) explain several methods of moral development that rely on imagination and visualization rather than overt action. These techniques are essential in cases where cultivating virtue the way one practices the harp is impossible. In particular, I focus on single-event virtues, first-time virtuous acts, and morally dangerous situations. (shrink)

In the biomedical context, policy makers face a large amount of potentially discordant evidence from different sources. This prompts the question of how this evidence should be aggregated in the interests of best-informed policy recommendations. The starting point of our discussion is Hunter and Williams’ recent work on an automated aggregation method for medical evidence. Our negative claim is that it is far from clear what the relevant criteria for evaluating an evidence aggregator of this sort are. What is the (...) appropriate balance between explicitly coded algorithms and implicit reasoning involved, for instance, in the packaging of input evidence? In short: What is the optimal degree of ‘automation’? On the positive side: We propose the ability to perform an adequate robustness analysis as the focal criterion, primarily because it directs efforts to what is most important, namely, the structure of the algorithm and the appropriate extent of automation. Moreover, where there are resource constraints on the aggregation process, one must also consider what balance between volume of evidence and accuracy in the treatment of individual evidence best facilitates inference. There is no prerogative to aggregate the total evidence available if this would in fact reduce overall accuracy. (shrink)

The empirical study of belief is emerging at a rapid clip, uniting work from all corners of cognitive science. Reliance on belief in understanding and predicting behavior is widespread. Examples can be found, inter alia, in the placebo, attribution theory, theory of mind, and comparative psychological literatures. Research on belief also provides evidence for robust generalizations, including about how we fix, store, and change our beliefs. Evidence supports the existence of a Spinozan system of belief fixation: one that is automatic (...) and independent of belief rejection. Independent research supports the existence of a system of fragmented belief storage: one that relies on large numbers of causally isolated, context-sensitive stores of belief in memory. Finally, empirical and observational data support at least two systems of belief change. One system adheres, mostly, to epistemological norms of updating; the other, the psychological immune system, functions to guard our most centrally held beliefs from potential inconsistency with newly formed beliefs. Refining our under- standing of these systems can shed light on pressing real-world issues, such as how fake news, propaganda, and brainwashing exploit our psychology of belief, and how best to construct our modern informational world. We present in this paper a novel ontological theory of events whose central tenet is the Aristotelian distinction between the object that changes and the actual subject of change, which is what we call an individual quality. While in the Kimian tradition events are individuated by a triple ⟨ o, P, t ⟩, where o is an object, P a property, and t an interval of time, for us the simplest events are qualitative changes, individuated by a triple ⟨ o, (...) q, t ⟩, where q is an individual quality inhering in o or in one of its parts. Detaching the individuation of events from the property they exemplify results in a fine-grained theory that keeps metaphysics and semantics clearly separate, and lies between the multiplicative and the unitarian approaches. We discuss then the way language refers to events, observing that, in most cases, event descriptions refer to complex, cognitively relevant clusters of co-occurring qualitative changes, which exhibit a synchronic structure depending on the way they are described. Contra Bennett, who famously argued that the semantics of event names ultimately depends on “local context and unprincipled intuitions”, we show how the lexicon provides systematic principles for individuating such clusters and classifying them into kinds. Finally, we address some open challenges in the semantics of locative and manner modifiers. (shrink)

We designed a new protocol requiring French adult participants to group a large number of Munsell colour chips into three or four groups. On one, relativist, view, participants would be expected to rely on their colour lexicon in such a task. In this framework, the resulting groups should be more similar to French colour categories than to other languages categories. On another, universalist, view, participants would be expected to rely on universal features of perception. In this second framework, the resulting (...) groups should match colour categories of three and four basic terms languages. In this work, we first collected data to build an accurate map of French colour terms categories. We went on testing how native French speakers spontaneously sorted a set of randomly presented coloured chips and, in line with the relativist prediction, we found that the resulting colour groups were more similar to French colour categories than to three and four basic terms languages. However, the same results were obtained in a verbal interference condition, suggesting that participants rely on language specific and nevertheless perceptual, colour categories. Collectively, these results suggest that the universalist/relativist dichotomy is a too narrow one. (shrink)

In a number of papers, Kit Fine introduced a theory of embodiment which distinguishes between rigid and variable embodiments, and has been successfully applied to clarify the ontological nature of entities whose parts may or may not vary in time. In particular, he has applied this theory to describe a process such as the erosion of a cliff, which would be a variable embodiment whose manifestations are the different states of erosion of the cliff. We find this theory very powerful, (...) and especially appropriate to capture the intuition that the same process may go on at different times. However, its formal principles have been subject to some criticisms, mainly concerning the mereological structure of a variable embodiment. Moreover, since the notion of variable embodiment is very general, simply saying that processes are variable embodiments is not enough to understand their ontological nature. To address these concerns, in this paper we proceed in two phases: first, we propose a revised version of Fine’s original theory adapted to the case of processes, which adopts a classical mereology instead of Fine’s hylomorphic mereology, and a temporalized constitution relation in place of Fine’s function of variable embodiment; second, we go deeper into the ontological nature of processes by revisiting the notions of homogeneity, intentionality, and telicity discussed in the literature, and propose an account based on ontological principles and not on semantic properties of predicates. This allows us to organize processes into a novel taxonomy based exclusively on their unity and individuation principles. (shrink)

We propose a novel ontological analysis of relations and relationships based on a re-visitation of a classic problem in the practice of knowledge repre- sentation and conceptual modeling, namely relationship reification. Our idea is that a relation holds in virtue of a relationship's existence. Relationships are therefore truthmakers of relations. In this paper we present a general theory or reification and truthmaking, and discuss the interplay between events and rela- tionships, suggesting that relationships are the focus of events, which emerge (...) from the context (the scene) they occur in. Despite intensive exegetical work, Plato’s description of dialectic in the Sophist still raises many questions. Through a close reading of this passage that contextualizes it in the general organisation of the Sophist, this paper provides answers to these questions. After presenting the difficult text, I contend that the “vowel-kinds” are necessary conditions for the blending of kinds. Then, I interpret the “cause of divisions” mentioned by the Stranger as the kinds responsible of the dichotomous division in the first half of (...) the dialogue. In the next part, I show that 235d5-e2 does not describe a procedure of “meta-divison” as some commentators have it, but that it describes the method of division itself. Finally, I connect the difficulty and the obscurity of the passage to the fact that dialectic is the supreme science and I explain why dialectic is the science of free men. (shrink)

It’s natural to think of acts of solidarity as being public acts that aim at good outcomes, particularly at social change. I argue that not all acts of solidarity fit this mold - acts of what I call ‘private solidarity’ are not public and do not aim at producing social change. After describing paradigmatic cases of private solidarity, I defend an account of why such acts are themselves morally virtuous and what role they can have in moral development.

Most physics theories are deterministic, with the notable exception of quantum mechanics which, however, comes plagued by the so-called measurement problem. This state of affairs might well be due to the inability of standard mathematics to “speak” of indeterminism, its inability to present us a worldview in which new information is created as time passes. In such a case, scientific determinism would only be an illusion due to the timeless mathematical language scientists use. To investigate this possibility it is necessary (...) to develop an alternative mathematical language that is both powerful enough to allow scientists to compute predictions and compatible with indeterminism and the passage of time. We suggest that intuitionistic mathematics provides such a language and we illustrate it in simple terms. (shrink)

In this article we examine the role of Entscheider (decision-makers) in the German asylum procedure, both legally and ethical. As the responsibility for deciding on asylum applications lies exclusively with them, their significance for the German asylum procedure can hardly be underestimated. However, over the last few decades the situation of Entscheider changed significantly: While the number and complexity of the cases they have to decide on has increased due to the growing immigration, the requirements for their education have been (...) lowered, owed to critical amendments to the relevant law. We analyze how the law currently defines the role of Entscheider, whether the legal framework is constitutional, and what modifications morality requires. Although the law defining their role seems to be constitutional, Entscheider’s education must be improved and they must be entrusted with the hearing of the applicants to meet what morality requires, we conclude. The article has two aims: (a) to show how the notion of self proposed by Zahavi allows to underlie different aspects of personal identity; (b) to provide some elements that strengthen and complement the arguments of the Danish philosopher. First, I begin with a phenomenological analysis of the acts. Second, I study the identity and the various levels of the self that underlie it. Finally, I present some elements to constitute a metaphysics of the human person as a complement to (...) Zahavi’s phenomenology, considering the philosophy of mind as a framework for reflection. It is usual to identify initial conditions of classical dynamical systems with mathematical real numbers. However, almost all real numbers contain an infinite amount of information. I argue that a finite volume of space can’t contain more than a finite amount of information, hence that the mathematical real numbers are not physically relevant. Moreover, a better terminology for the so-called real numbers is “random numbers”, as their series of bits are truly random. I propose an alternative classical mechanics, which is (...) empirically equivalent to classical mechanics, but uses only finite-information numbers. This alternative classical mechanics is non-deterministic, despite the use of deterministic equations, in a way similar to quantum theory. Interestingly, both alternative classical mechanics and quantum theories can be supplemented by additional variables in such a way that the supplemented theory is deterministic. Most physicists straightforwardly supplement classical theory with real numbers to which they attribute physical existence, while most physicists reject Bohmian mechanics as supplemented quantum theory, arguing that Bohmian positions have no physical reality. Imagine that your body has become attached, without your permission, to that of a sick violinist. The violinist is a human being. He will die if you detach him. Such detachment seems, nonetheless, to be morally permissible. Thomson argues that an unwantedly pregnant woman is in an analogous situation. Her argument is considered by many to have established the moral permissibility of abortion even under the assumption that the foetus is a human being. Another popular argument is that presented by (...) Singer and Unger to the effect that even those who are moderately prosperous are morally obliged to help the poor if they can do so at relatively small cost to themselves. Resumen: Este trabajo se propone revisar la tesis de la proliferación de alternativas, expuesta por Boaventura de Sousa Santos, a la luz de algunas críticas a la tesis de la proliferación de teorías, expuesta por Paul Feyerabend. Se defiende que, aunque no de modo explícito, hay una afinidad entre ambas tesis y, en consecuencia, las debilidades de la segunda afectan a la primera. I claim that, though not in explicit way, there is an affinity between them, therefore the weakness from the second one affects the first one. However, the point is to show how some emergent proposals, as the ecology of knowledges, could benefit from a full epistemological discussion, instead of insisting on its counter-epistemological nature. I defend a Deferred Ostension view of quotation, on which quotation-marks are the linguistic bearers of reference, functioning like a demonstrative; the quoted material merely plays the role of a demonstratum. On this view, the quoted material works like Nunberg’s indexes in his account of deferred ostensión in general. The referent is obtained through some contextually suggested relation; in the default case the relation will be … instantiates the linguistic type __, but there are other possibilities. In this way, the (...) deferred ostension view deals with a problem I pointed out for the identity proposal in my earlier work, that we do not merely refer with quotations to expression-types, but also to other entities related in some way to the relevant token we use: features exhibited by the token distinct from those constituting its linguistic type, features exhibited by other tokens of the same type but not by the one actually used (as when, by using a graphic token, we refer to its phonetic type), or even other related tokens (see the examples on p. 261 of García-Carpintero 1994). Victims of oppression are often called to let go of their anger in order to facilitate better discussion to bring about the end of their oppression. According to Amia Srinivasan, this constitutes an affective injustice. In this paper, we use research on emotion regulation to shed light on the nature of affective injustice. By drawing on the literature on emotion regulation, we illustrate specifically what kind of work is put upon people who are experiencing affective injustice and why it is (...) damaging. We begin by explaining affective injustice and how it can amount to a call for emotion regulation. Then we explain the various techniques that can be used to regulate emotions and explain how each might be harmful here. In the penultimate section of the paper, we explain how the upshot of this is that victims of affective injustice are left with a dilemma. Either they try to regulate their anger in a way that involves ignoring the fact of their oppression or they regulate it in a way that is likely to be harmful for them. Finally, we consider whether there are any good solutions to this dilemma, and how this issue opens up the possibility for further research into emotion regulation and moral philosophy. (shrink)

World food production is facing exorbitant challenges like climate change, use of resources, population growth, and dietary changes. These, in turn, raise major ethical and political questions, such as how to uphold the right to adequate nutrition, or the right to enact a gastronomic culture and to preserve the conditions to do so. Proposals for utopic solutions vary from vertical farming and lab meat to diets filled with the most fanciful insects and seaweeds. Common to all proposals is a polarized (...) understanding of food and diets, famously captured by Warren Belasco in the contraposition between technological fixes and anthropological fixes. According to the first, technology will deliver clean, just, pleasurable, affordable food; future generations will not need to adjust much of their dietary cultures. According to the second, future generations should dramatically change their dietary habits (what they eat and how they eat it) to achieve a sustainable diet. The two fixes found remarkably distinct perspectives over dietary politics and the ethics of food production and consumption. In this paper we argue that such polarized thinking rests on a misrepresentation of the ontological status of food, which in turn affects the underlying ethical and political issues. Food is a socially constructed object that draws in specific ways on habits, norms, traditions, geographical, and climatic conditions. Although this thesis seems somewhat obvious, its consequences on the ethical and political perspectives on the future of food have not been derived properly. After introducing the issue at stake (¤1), we point out the polarities that characterize food utopias (¤2) and their ontological faults (¤3). We hence suggest that a socio-ontological analysis of food can better deliver the principles for a foundation of food utopias (¤4). (shrink)

In a world that is overflowing with journals and other outlets for scientific publication, the appearance of any new periodical requires some justification. There are already more journals than we can read and more conferences than we can attend. In the case of applied Ontology, we believe that the creation of anew journal not only is completely justifiable, it is downright exciting. For too long, workers in computer science have assumed that content comes for free. “Theory” in computer science has (...) always meant the theory of processes and of computation. We measure the complexity of computer programs in terms of how long it takes machines to execute them, not in terms of how long it takes people to understand and to represent the data on which those programs might operate. We typically describe computer code in terms of algorithms that operate on formal parameters, often without pausing to discuss where the data that might satisfy those parameters come from. This journal was founded on the premise that workers in computer science, informatics, and information science are overdue in paying as much attention to contents as they do to algorithms. (shrink)

It is usual to identify initial conditions of classical dynamical systems with mathematical real numbers. However, almost all real numbers contain an infinite amount of information. I argue that a finite volume of space can’t contain more than a finite amount of information, hence that the mathematical real numbers are not physically relevant. Moreover, a better terminology for the so-called real numbers is “random numbers”, as their series of bits are truly random. I propose an alternative classical mechanics, which is (...) empirically equivalent to classical mechanics, but uses only finite-information numbers. This alternative classical mechanics is non-deterministic, despite the use of deterministic equations, in a way similar to quantum theory. Interestingly, both alternative classical mechanics and quantum theories can be supplemented by additional variables in such a way that the supplemented theory is deterministic. Most physicists straightforwardly supplement classical theory with real numbers to which they attribute physical existence, while most physicists reject Bohmian mechanics as supplemented quantum theory, arguing that Bohmian positions have no physical reality. Cet article est consacré au problème du rapport entre l’entrelacement des genres (συμπλοκὴ τῶν εἰδῶν) et le logos dans le Sophiste. Après avoir brièvement présenté le problème, je discute, dans la première partie, différentes solutions proposées par les commentateurs. Je cherche à montrer qu’aucune de ces solutions n’est pleinement satisfaisante. Dans la deuxième partie, je propose une nouvelle solution au problème de la συμπλοκὴ τῶν εἰδῶν fondée sur une distinction entre deux types de logos, le logos dialectique et le logos (...) doxique. Dans la troisième partie, je cherche à justifier textuellement cette solution en recourant à la fois au texte du Sophiste lui-même et à la dernière partie du Théétète. Dans ma conclusion, je suggère que la distinction entre logos dialectique et logos doxique correspond à une différence qui traverse toute l’œuvre de Platon, à savoir la différence entre connaissance et opinion. / This paper deals with the problem of the συμπλοκὴ τῶν εἰδῶν in the Sophist. In the first part, after a brief presentation of this problem, I discuss different solutions which have been proposed in the recent literature. I try to show that none of them is entirely satisfying. In the second part, I propose and explain a new solution based on a distinction between two types of logos : dialectical logos and doxastic logos. In the third part, I try to justify this solution on the basis of some passages of the Sophist and of the final part of the Theaetetus. To conclude, I suggest that the distinction between dialectical logos and doxasticlogos matches the difference between knowledge and belief made by Plato in his dialogues. (shrink)

Do scientific theories limit human knowledge? In other words, are there physical variables hidden by essence forever? We argue for negative answers and illustrate our point on chaotic classical dynamical systems. We emphasize parallels with quantum theory and conclude that the common real numbers are, de facto, the hidden variables of classical physics. Consequently, real numbers should not be considered as ``physically real" and classical mechanics, like quantum physics, is indeterministic.

I examine the two-level utilitarian case for humane animal agriculture (by R. M. Hare and Gary Varner) and argue that it fails on its own terms. The case states that, at the ‘intuitive level’ of moral thinking, we can justify raising and killing animals for food, regarding them as replaceable, while treating them with respect. I show that two-level utilitarianism supports, instead, alternatives to animal agriculture. First, the case for humane animal agriculture does not follow from a commitment to two-level (...) utilitarianism combined with a commitment to respecting animal lives. Secondly, the two-level utilitarian case falls prey to a compartmentalization problem and cannot uphold both respect and replaceability. What I call ‘humane lives’ are not appropriately valued by the lights of two-level utilitarianism itself. (shrink)

This Article draws attention to a conceptual point that has been overlooked in recent discussions about the theoretical foundations of contract law. I argue that, rather than enforcing the obligations of promises, contract law concerns complaints against promissory wrongs. This conceptual distinction is easy to miss. If one assumes that complaints arise whenever an obligation has been violated, then the distinction does not seem meaningful. I show, however, that an obligation can be breached without giving rise to a valid complaint. (...) This Article illustrates the importance of this conceptual distinction by focusing first on the doctrine of substantive unconscionability. I claim that the doctrine can be best explained by the way in which a party who engages in exploitative behavior may lose her moral standing to complain. It is because such a party has lost her moral standing to complain that the law, through unconscionability doctrine, bars her from bringing a legal complaint. This explanation avoids the oft-issued charge of paternalism and it also offers benefits over an alternative state-oriented account developed recently by Seana Shiffrin. Using the conceptual distinction behind this account of unconscionability, this Article further argues that recent theoretical debates about the relationship between contract law and morality have been largely misconceived. Those debates have focused on whether contract law and morality impose parallel obligations. Once one appreciates the difference between imposing obligations and recognizing complaints, the comparison looks quite different. Contract law recognizes valid complaints against broken promises, much as morality recognizes moral complaints. (shrink)

In General Relativity, the terms ‘reference frame’ and ‘coordinate system’ must be distinguished. The former refers to physical systems that are dynamically coupled with the gravitational field, aside from possible approximations, while the latter refers to a set of mathematical variables that are representative artefacts. This necessary distinction is lost in pre-general relativistic physics, where we can choose as a reference frame a system of real physical objects that is not affected and cannot affect the physical system under consideration. Therefore, (...) we can make it coincide with a coordinate system without the need for approximations. We propose a a novel three-fold distinction between three types of reference frames, considered as material systems. In particular, we discern between Idealised Reference Frames, Dynamical Reference Frames and Real Reference Frames, depending on their increasing physical role in the total dynamics. Using a Bianchi I model in Minisuperspace, we give a cosmological example of the use of a gravitational Dynamical Reference Frame, namely a reference frame constructed with gravitational degrees of freedom in the standard case where the gravitational stress-energy tensor is not defined in the Einstein field equations. We also analyse the role of active and passive diffeomorphisms in changing a reference frame. (shrink)

A growing literature argues that animals can act for moral reasons without being responsible. I argue that the literature often fails to maintain a clear distinction between moral behavior and moral agency, and I formulate a dilemma: either animals are less moral or they are more responsible than the literature suggests. If animals can respond to moral reasons, they are responsible according to an influential view of moral responsibility–Quality of Will. But if they are responsible, as some argue, costly implications (...) must be acknowledged. If, however, they should not be considered responsible, then we may have to reassess the meaning of animal morality. I discuss ways to eschew responsibility or to tailor it to animals and argue that each requires a revised conception of animal morality. (shrink)

Is suffering really bad? The late Derek Parfit argued that we all have reasons to want to avoid future agony and that suffering is in itself bad both for the one who suffers and impersonally. Nietzsche denied that suffering was intrinsically bad and that its value could even be impersonal. This paper has two aims. It argues against what I call ‘Realism about the Value of Suffering’ by drawing from a broadly Nietzschean debunking of our evaluative attitudes, showing that a (...) recently influential response to the debunking challenge (the appeal to phenomenal introspection) fails. It also argues that a Nietzschean approach is well suited to support the challenge and is bolstered by the empirical literature. As strangers to ourselves, we cannot know whether suffering is really intrinsically bad for us. (shrink)

The Philosopher and Writer Jean-Paul Sartre, in the dramatic work No Exit (1944), claims the inter-subjective relationship is full of conflict and that it is impossible to reach the dialogical ideal. We will confront Sartre´s conclusions from the proposal of the jewish philosopher Emmanuel Levinas in order to see his thesis about otherness. We will explain how, instead of some rational agreements that overcome the diversity inside totality, it is necessary to receive the other and respond to him in the transcendence that Infinity requires. The nature and role of the patient in biomedicine comprise issues central to bioethical inquiry. Given its developmental history grounded firmly in a backlash against 20th-century cases of egregious human subjects abuse, contemporary medical bioethics has come to rely on a fundamental assumption: the unit of care is the autonomous self-directing patient. In this article we examine first the structure of the feminist social critique of autonomy. Then we show that a parallel argument can be made against relational autonomy as (...) well, demonstrating how this second concept of autonomy fails to take sufficiently into account an array of biological determinants, particularly those from microbial biology. Finally, in light of this biological critique, we question whether or to what extent any relevant and meaningful view of autonomy can be recovered in the contemporary landscape of bioethics. The claim that the observation of a violation of a Bell inequality leads to an alleged alternative between nonlocality and non-realism is annoying because of the vagueness of the second term.

The paper aims at analyzing the inner development of self-identity from its pre-reflective level to the full awareness one. The recent findings of neurosciences and cognitive studies suggest focusing attention on the complex relation between self as consciousness and self as subjectivity, both with regard to their interdependency and to their reference to a shared context. Phenomenology, thanks to the careful consideration of the issues regarding the constitution of mental life articulated by its classic researches and current inquires, offers a (...) valuable opportunity to set the scientific outcomes in an authentically philosophical perspective. The method of the transcendental reduction, which takes place as a return revealing the subjectivity to itself, makes possible to grasp the link connecting the worldly reality and the egological dimension, i.e. the world’s becoming in the ways of the originally subjective constitution. The legitimate aim of the psychological experience to understand the basic structures of the life-consciousness can find in the conceptual figure of the phenomenological reduction both a valid methodological approach and a useful terms of comparison.

The διακριτικὴ τέχνη (the art of separating or discriminating), from which the sixth definition of theSophiststarts (226b1–231b9), is puzzling.Prima faciethe art of separating does not fit the initial division of art between ποιητικὴ τέχνη (production) and κτητικὴ τέχνη (acquisition) at 219a8–c9. Therefore, scholars generally agree that, although mutually exclusive, ποιητική and κτητική are not exhaustive and leave room for a third species of art, διακριτικὴ τέχνη, on a par with ποιητική and κτητική. However, I argue that textual evidence suggests otherwise.
